Model Arbitration Clause

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration (the SCIA) for arbitration. 

Optional Appellate Arbitration Procedure Model Clause

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration (the SCIA)for arbitration. The parties grant each other the right to appeal to the SCIA against the award or awards rendered by the arbitral tribunal. The appellate tribunal renders the final award. The place of arbitration shall be            .(State the country or jurisdiction where the Appellate Arbitration is not prohibited)

“SCIA Mediation + SCIA Arbitration” Model Clause

Any dispute arising from or in connection with this Contract shall be submitted to the Shenzhen Court of International Arbitration (the SCIA) Mediation Center for mediation. If the mediation is successful, the parties agree to submit the settlement agreement to the SCIA to request that an arbitral award be rendered in accordance with the Arbitration Rules and based on the terms of the settlement agreement. If any party is unwilling to mediate or the mediation fails, the dispute shall be referred to the SCIA for arbitration.

“Settlement Agreement + SCIA Arbitration” Model Clause

Both parties agree that either party has the right to submit this settlement agreement to the Shenzhen Court of International Arbitration (the SCIA)to request that an arbitral award be rendered in accordance with the Arbitration Rules and based on the terms of the settlement agreement. The arbitration award is final and binding on both parties.

“SCIA Negotiation Facilitation+ SCIA Arbitration” Model Clause (Before the Dispute Arose)

Any dispute arising from or in connection with this Contract shall be submitted to Negotiation Facilitation Center of Shenzhen Court of International Arbitration (the SCIA) for negotiation facilitation.

If the negotiation facilitation turns to a settlement, the parties agree to submit the settlement agreement to the SCIA to request that an arbitral award be rendered in accordance with the Arbitration Rules and based on the terms of the settlement agreement.

If any party quits the negotiation facilitation or the negotiation facilitation fails, the dispute shall be submitted to the SCIA for arbitration.

“SCIA Negotiation Facilitation+ SCIA Arbitration” Model Clause (After the Dispute Arose)

The parties agree to submit the dispute to Negotiation Facilitation Center of Shenzhen Court of International Arbitration (the SCIA) for negotiation facilitation.

If the negotiation facilitation turns to a settlement, the parties agree to submit the settlement agreement to the SCIA to request that an arbitral award be rendered in accordance with the Arbitration Rules and based on the terms of the settlement agreement.

South China International Arbitration Center (HK) Model Arbitration Clause

Any dispute arising from or in connection with this contract shall be submitted to the South China International Arbitration Center (HK) for arbitration.

SCIA Jiangmen Center Model Arbitration Clause

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration Jiangmen Center for arbitration.

SCIA Kashi Center Model Arbitration Clause

Model Arbitration Clause 1:

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration Kashi Center for arbitration.

Model Arbitration Clause 2:

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration (the SCIA) for arbitration. The arbitration shall be conducted at the Shenzhen Court of International Arbitration Kashi Center.

China (Shenzhen) Securities and Futures Arbitration Center Model Arbitration Clause

Model Arbitration Clause 1:

Any dispute arising from or in connection with this contract shall be submitted to the China (Shenzhen) Securities and Futures Arbitration Center for arbitration.

Model Arbitration Clause 2:

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration (the SCIA) for arbitration. The arbitration shall be conducted at the China (Shenzhen) Securities and Futures Arbitration Center.

Model Arbitration Clause 3:

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Securities and Futures Dispute Resolution Center for mediation. If any party is unwilling to mediate or the mediation fails, the dispute shall be referred to the China (Shenzhen) Securities and Futures Arbitration Center for arbitration.

(The parties may also agree to submit the dispute for mediation by a national or local capital market industry association such as the Securities Association of China, the China Futures Association, the China Association for Listed Companies, and the Asset Management Association of China.)

China (Shenzhen) Intellectual Property Arbitration Center Model Arbitration Clause

Model Arbitration Clause 1:

Any dispute arising from or in connection with this contract shall be submitted to China (Shenzhen) Intellectual Property Arbitration Center for arbitration.

Model Arbitration Clause 2:

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration (the SCIA) for arbitration. The arbitration shall be conducted at the China (Shenzhen) Intellectual Property Arbitration Center.

SCIA Maritime Arbitration Center Model Arbitration Clause

Model Arbitration Clause 1:

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration Maritime Arbitration Center (SCIAMAC) for arbitration.

Model Arbitration Clause 2:

Any dispute arising from or in connection with this contract shall be submitted to the Shenzhen Court of International Arbitration (the SCIA) for arbitration. The arbitration shall be conducted at the SCIA Maritime Arbitration Center (SCIAMAC).
